As a top luxury listing agent in Sarasota, one of the first decisions I help sellers make is choosing the right Florida real estate contract. Many homeowners default to the “As-Is” contract, thinking it’s the easiest path to closing—but in the luxury market, that’s not always the case.
In Florida, there are two primary residential contracts:
The “As Is” Residential Contract for Sale and Purchase
The Standard Residential Contract
Both are valid, widely used FAR/BAR forms—but they serve different purposes and come with distinct pros and cons. Let’s break it down:
1. The “As-Is” Contract
This contract means the property is being sold in its current condition. The seller is not obligated to make any repairs, although the buyer can still perform inspections.
Pros:
No Repair Obligation: The seller won’t be required to fix anything uncovered during inspections.
Buyer Flexibility: Buyers can cancel for any reason during the inspection period.
Faster Listing Preparation: No need for pre-market repairs or touch-ups.
Cons:
Can Signal Risk: In luxury real estate, “as-is” can create a perception that something’s wrong, even if the home is in excellent condition.
More Renegotiation: Buyers often use inspection results to push for price reductions.
Higher Risk of Walkaways: Because buyers can back out without cause, deals may fall apart more easily.
2. The Standard Contract
This version includes repair obligations, with specific dollar limits agreed to by both parties. The buyer still conducts inspections, but cannot walk away without cause.
Pros:
Stronger Buyer Commitment: Buyers can’t walk away as easily after inspections.
Predictable Repairs: Sellers agree to capped repair amounts for general items, WDO (wood-destroying organisms), and permits.
More Buyer Confidence: Using a Standard Contract can signal that the property is well-maintained and move-in ready.
Cons:
Seller May Incur Costs: Sellers may be required to complete repairs or provide credits, depending on inspection findings.
More Negotiation: Post-inspection discussions may take longer to resolve.

In the Sarasota luxury market, presentation and perception are everything. While the “As-Is” contract is useful for estate sales or homes needing renovation, it may work against sellers of well-maintained properties. If your home is in excellent shape, a Standard Contract can position it as a premium product—and make the buyer feel more confident and committed.
